I keep hoping that things will change and they will leave these eagles alone to nest. I just shake my head. I have my coasters on my coffee table of mom and dad NOrfolk but do not let anyone use them politicians |

OK...Judge just issued a ruling. The USDA had petitioned the court to be removed from this litigation...Didn't work. Here's the ruling..posted today (9/9)
FROM EAGLE ON ALLIANCE LAWSUIT Norfolk, Virginia –Today the United States District Court for the District of Norfolk denied the United States Department of Agriculture’s (USDA’s) Motion to Dismiss Eagle On Alliance’s (EOA) lawsuit against the agency for its role in the ongoing nest removal activity and harassment of the Norfolk Botanical Garden (NBG) eagles. Earlier this year, the USDA asked the Court to dismiss the agency from the lawsuit, arguing that they were merely contractors hired by the City of Norfolk to perform the harassment and nest removal activity at the center of the litigation. The USDA told the Court that the City of Norfolk would continue to harass the NBG eagle pair even if the agency was not the entity doing it. The District Court rejected the USDA’s attempt to minimize its involvement in the ongoing nest removal and harassment activities at the Garden. The Court determined that because the USDA was conducting the activity challenged in the lawsuit, that the agency would remain a proper defendant in the case. EOA, a local grassroots environmental organization whose mission is to protect the two resident bald eagles at NBG, filed suit in Federal Court challenging a permit issued to the City of Norfolk by the U.S. Fish and Wildlife Service (FWS) for the harassment of the NBG bald eagle pair. EOA believes that not enough is being done on airport property to keep the flying public safe and that the FWS and USDA are required to improve wildlife mitigation measures at the airport before authorizing the harassment of federally protected bald eagles at the NBG. The USDA-WS is the agency tasked by the Federal Aviation Administration (FAA) through a memorandum of understanding with assessing and reducing wildlife hazards at airports. In this capacity, USDA-WS is the agency that initially told the City of Norfolk that nest removal and harassment of the NBG eagles was necessary. The lawsuit will proceed on the merits with both the FWS and the USDA as defendants. |

MR MAYOR, VICE MAYOR, MEMBERS OF COUNCIL, MR. CITY MANAGER NORFOLK BOTANICAL GARDEN BALD EAGLE UPDATE FOR CITY COUNCIL, SEPTMBER 9, 2014 • It has now been almost two years since the City of Norfolk authorized the removal of the first bald eagles’ nest at Norfolk Botanical Garden. • Since October 4, 2012, a total of nine nests have been removed from the Garden. • THE NBG RESIDENT BALD EAGLE PAIR REMAINS IN THE GARDEN. • AND TWO MORE BALD EAGLES HAVE BEEN STRUCK AND KILLED AT NORFOLK INTERNATIONAL AIRPORT JUST THIS YEAR – AN ADULT IN JANUARY AND A JUVENILE IN APRL – BOTH WERE IDENTIFIED AS TRANSIENT EAGLES. • The NBG resident pair is NOT protecting its territory by keeping other eagles away because it has no nest to protect just as EOA’s Eagle Expert Peter Nye* predicted. • It was been documented that more and more eagles are moving into and through the airport/garden area. In fact according to the airport’s own records, bald eagle sightings at the airport have increased 333%** since the City began removing NBG nests as compared to the same period prior to nest removal. This increase in eagle sightings cannot be attributed to the NBG eagles and their young as claimed by Scott Barras of the USDA-Wildlife Services. The NBG eagles have not been allowed to nest or breed in the area for the last 23 months. • Thousands and thousands of dollars have been paid by the Airport to USDA-Wildlife Services to harass two bald eagles at NBG and remove their nests. Today Judge Henry Morgan denied the USDA-WS’s motion to dismiss the agency from our federal lawsuit. The USDA-WS is tasked by the Federal Aviation Administration (FAA) through a memorandum of understanding with assessing and reducing wildlife hazards at airports. The agency clearly needs to do more at Norfolk International. We respectfully request that the city not apply for another permit to remove more nests at the garden. It is time to move to plan B! We request that you insist that full-time comprehensive action be taken ON AIRPORT PROPERTY to make the flying public safe from all wildlife strikes. Airplanes do not take off or land at Norfolk Botanical Garden. In closing, Eagle On Alliance will be hosting a Rally For The Eagles on October 4, 2014 at 11 a.m. at Norfolk Botanical Garden. We cordially invite all of you to attend. Many, many eagle fans from Norfolk, the commonwealth, the country and the world will be attending. And all of those who will be traveling here from distance for the weekend will be staying in Norfolk hotels and eating at Norfolk restaurants. They are doing this at our request. But we could not, in good conscience, have anyone fly into Norfolk International Airport. All who are flying in will be flying into Newport News/Williamsburg. We would like for all of you to help us change our airport policy. Help us make the Norfolk airport safe from wildlife strikes and safe for the flying public by keeping the runways clear of ALL wildlife including the NBG eagles. Interesting that the "fix" totally backfired and now there 33% more eagle sightings now than before they started removing the nests. Thanks for sharing SGB! |
